Fire Code Violation Conviction

Port Colborne, ON (July 18, 2018) – On July 18, 2018, the owner of 53 Nickel Street was convicted on two counts in Provincial Offences Court for failing to comply with the Ontario Fire Code and was fined $100,000 (plus a victim surcharge of 25%), in accordance with the provisions of the Fire Protection and Prevention Act.

On December 14, 2016, Port Colborne Fire & Emergency Services responded to a reported structure fire. Responding crews found the dwelling to be fully involved on arrival. Four occupants of the dwelling lost their lives that morning. During the investigation it was determined that the owner of the dwelling failed to maintain the smoke alarms and test the smoke alarms annually.

“This tragic event will have an everlasting effect on the families, friends and emergency response personnel involved, as well as our community as a whole,” said City of Port Colborne’s Fire Chief, Thomas B. Cartwright. “Our community must make every effort to live a fire safe life.”

Chief Cartwright reminds all residents and owners of buildings in Port Colborne of their responsibilities under the Ontario Fire Code. Smoke and carbon monoxide alarms must be installed and maintained. Failing to meet these requirements could result in fines of up to fifty thousand dollars ($50,000.00) per count.

Port Colborne residents that require assistance in determining whether they are in compliance are encouraged to call Port Colborne Fire & Emergency Services at 905-834-4512.
